Discrimination Based on Marital Status

United States v. Windsor was a landmark 2013 case in which the Supreme Court struck down the Defense of Marriage Act (DOMA), which described marriage as a union between a male and a female. DOMA was considered unconstitutional because it was in violation of the Fifth Amendment and deprived persons of equal liberty under the law. It also prevented the states from instituting their own laws banning same-sex marriage. In Minnesota, you have the right to marry who you choose, and a right to work in a workplace free from sexuality-based discrimination. Your marriage should not affect how you are treated in the workplace, and if you believe you have been targeted based on your same-sex marriage (or a marriage in which one or more partners is gender-nonconforming or transgender), contact an attorney as soon as possible.
